Terms & Conditions / Terms of Service

Effective Date: 11/18/2025

By booking services, approving an estimate, signing electronically, or submitting payment, the Client (“Client”) agrees to the following Terms & Conditions with ProClean Services of South Brevard (“ProClean”).

1. Scheduling, Cancellations & Rescheduling

1.1. Clients must provide a minimum of 24 hours’ notice to cancel or reschedule an appointment.

1.2. Same-Day Cancellations & No-Shows
Cancellations made with less than 24 hours’ notice, including same-day cancellations, lockouts, or denied access, may be subject to a fee of 50% of the scheduled service amount.

If our team arrives at the property and is unable to perform the service due to lack of access, unsafe conditions, or failure to secure pets, the full scheduled service amount may be charged.

1.3. ProClean reserves the right to reschedule services due to staffing availability, weather conditions, equipment issues, or safety concerns.

2. Access to Property

2.1. Client is responsible for ensuring safe, unobstructed access to the property at the scheduled service time, including access to all areas agreed upon for cleaning.

2.2. Client must ensure working water and electricity are available for the duration of the service. If required utilities are unavailable or shut off, ProClean may be unable to perform the service, and the appointment may be treated as a same-day cancellation.

2.3. If access is not provided within 15 minutes of arrival, the appointment may be treated as a same-day cancellation.

2.4. ProClean reserves the right to refuse or discontinue service if conditions are unsafe, unsanitary, hazardous, or pose a risk to staff.
3. Payment Terms

3.1. Payment is due upon completion of services unless otherwise agreed to in writing.

3.2. Accepted payment methods include electronic payment, credit/debit card, ACH, or other approved methods.

3.3. Late or unpaid invoices may result in late fees, service suspension, or termination of services.

3.4. Client agrees to pay all costs associated with collections, including administrative fees, legal costs, and attorney fees.

3.5. Chargebacks or disputed payments may result in additional administrative fees and immediate suspension or termination of services.

4. Estimates, Pricing & Scope of Work

4.1. All estimates are based on information provided by the Client and are subject to adjustment if actual conditions differ.

4.2. Additional charges may apply for excessive dirt, buildup, clutter, pet hair, bodily fluids, biohazards, or conditions not disclosed at the time of booking.

4.3. ProClean reserves the right to adjust pricing due to changes in labor, materials, fuel, or operational costs.

4.4. ProClean does not guarantee the removal of permanent stains, odors, discoloration, or damage.

5. Recurring Services

5.1. Recurring service pricing is based on the expectation of ongoing maintenance of the property.

5.2. If service frequency is reduced or the condition of the property declines, pricing may be adjusted accordingly.

5.3. Skipped visits do not reset pricing unless approved by ProClean in writing.

6. Quality Assurance & Service Claims

6.1. Any service concerns must be reported within 24 hours of service completion.

6.2. ProClean will return to address valid concerns at no additional charge.

6.3. Refunds are not provided for completed services.

7. Liability & Limitations

7.1. ProClean is insured and takes reasonable care while performing services.

7.2. ProClean is not responsible for:

Pre-existing damage

Normal wear and tear

Fragile, unstable, or unsecured items

Improperly installed fixtures or surfaces

Damage caused by age or condition of the property

7.3. Any claim for accidental damage must be reported within 24 hours of service completion.

7.4. ProClean is not liable for losses caused by events beyond its control, including power outages, water issues, or acts of nature.

8. Safety & Working Conditions

8.1. For safety reasons, staff will not:

Move heavy furniture or appliances

Climb ladders beyond approved height

Work in hazardous, pest-infested, or biohazard environments

8.2. Pets must be secured during service. ProClean is not responsible for escaped animals.

9. Post-Construction, Move-Out & Specialty Cleaning

9.1. These services require additional time, labor, and specialized procedures and are priced accordingly.

9.2. Client acknowledges that post-construction dust may resettle for several days and does not constitute a service failure.

9.3. Pricing may be adjusted if site conditions differ significantly from what was disclosed prior to service.

10. Supplies & Utilities

10.1. ProClean provides standard cleaning supplies and equipment unless otherwise agreed in writing.

10.2. Client must provide working electricity and water during service.

10.3. Any product sensitivities, allergies, or preferences must be disclosed prior to service.

11. Photos & Documentation

11.1. ProClean may take before-and-after photos for quality control, training, documentation, or insurance purposes.

11.2. Personal identifying information or sensitive items will not be intentionally photographed.

12. Non-Solicitation of Employees

12.1. Client agrees not to solicit, hire, or contract with ProClean employees or contractors during service and for 12 months thereafter.

12.2. A violation of this clause may result in a placement fee of $2,500.

13. Termination of Services

13.1. Either party may terminate services at any time.

13.2. Any outstanding balances remain due upon termination.

14. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of Florida.

15. Acceptance of Terms

By booking services, approving an estimate, signing electronically, or submitting payment, the Client acknowledges that they have read, understood, and agreed to these Terms & Conditions.
